For perfectly sensible reasons the British Justice system (still considered to be the world's fairest)evolved
the laws of libel, slander and defamation to ensure that the individual had the possibility of due legal process to protect his or her reputation.
Is Mr Derakhshan claiming that he will not receive justice from a US or Canadian Court ?
Rhetorically I suspect he is likely to get a better quality of justice than he would in any Iranian Court.
It is just a question of growing up and defending himself in a Court rather than in the ether !

Persian Diva: My comment was specifically about how Hoder dealt with the ISP, not about demands of the lawyer. They are separate issues. Although I agree that requesting user IPs is ridiculous, that has very little to do with the way that Hoder dealt with the ISP representative (who actually came out looking much more thoughtful than he did).

I happen to also think the "personal" layer of the story is very important. The tendency to turn every issue of freedom of speech into a childish black-and-white "I should be able to say what I want" rant overlooks the fact that freedom of speech is rarely absolute. The freedom to say anything about anybody without repercussions leads to stories like this one and this one. There are always bounds, it is a matter of where they are drawn, who draws them, and how they are decided upon.

> Sam: Don’t believe everything that kamangir says. He is Gossip-specialist.

> Chris Salzberg: a lawyer asking an ISP to hand over users IP addresses doesn't chock you? Why are you people so stuck to the "personal" layer of the story, this is about our freedom of expression that is being threatened here with such ISP and lawyers.

Everyone interested in this debate should have a look at the email exchange between Hoder and the ISP. (maybe it's linked in the article above but I couldn't find it)

Regardless of the issues involved, I personally was less than impressed by the way Hoder dealt with the problem. He didn't give any indication that he was interested in resolving the dispute at a human level. Throwing around references to Richard Perle and Paul Wolfowitz might score points with some camps, but it strikes me as completely bizarre in the context of an email exchange with an ISP.
